BENGALURU:
The Karnataka Real Estate Regulatory Authority (Karnataka RERA) has directed
Eco Life Developers to establish a formal association of allottees within 60
days, underlining the importance of homebuyers’ collective representation and
compliance with real estate regulations.
The direction requires the developer to take steps to
bring allottees together under a formal association, providing a recognised
platform through which homeowners can collectively address matters concerning
their project.
Why Is an Association of Allottees
Important?
An association of allottees plays a significant role
in protecting homebuyers’ interests and facilitating communication between
residents and the developer. It provides a collective forum to raise concerns
relating to project completion, common areas, maintenance, amenities and other
issues affecting property owners.
A formally constituted association can also help
homeowners coordinate decisions concerning the management and upkeep of shared
facilities and represent their collective interests when dealing with the
builder or relevant authorities.
RERA Compliance and Homebuyer Rights
The Real Estate (Regulation and Development) Act,
2016, provides a regulatory framework intended to improve transparency,
accountability and consumer protection in the real estate sector. The law also
contains provisions concerning the formation of associations or societies of
allottees and the transfer of common areas and project-related
responsibilities, subject to the applicable statutory requirements.
Karnataka RERA’s direction to Eco Life Developers
reinforces the need for developers to fulfil their obligations towards
homebuyers and ensure that the interests of allottees are appropriately
represented.
What Happens Next?
Eco Life Developers has been given a strict deadline
of 60 days to establish the association. The direction puts the onus on the
developer to complete the required formalities within the stipulated period.
For homebuyers, the formation of an association can be
an important step towards better coordination, collective representation and
more structured engagement with the developer.
The specific project details, the date of the
regulatory order and any additional directions issued by Karnataka RERA would
be necessary to establish the full scope of the order and the precise
compliance requirements.
